Terms
The agreement between you and D2V Solutions for use of Pharos. The section that matters most is the one about sending: Pharos hands your email to your own provider, which makes you the sender, with everything that follows from that.

Draft. The facts here — where data is hosted, how long it is kept, what is deleted when — have been checked against the running system. What is still missing is the company's registered details, the governing law, and a lawyer's review; anything in square brackets is one of those. This is not legal advice, and counsel should review it before Pharos accepts customers.
The service
Pharos is a marketing operations tool: contacts, lists, campaigns, automations, transactional email, mention monitoring, social publishing and revenue reporting, exposed through a dashboard, an HTTP API and an MCP server. By creating an account or using the API you agree to these terms.
We may change the service over time. If we remove something you materially depend on, we will give you reasonable notice.
You are the sender
Pharos does not send email on its own credentials. You connect your own Resend or Amazon SES account, and every message goes out through it, from your domain. In law and in practice you are the sender of record. That means:
- You must have a lawful basis to email every address on your lists — consent where consent is required. Purchased, scraped or rented lists are not permitted.
- You must honour unsubscribes promptly. Pharos adds a working unsubscribe link and one-click headers to marketing mail and suppresses hard bounces and spam complaints automatically; you must not remove or defeat these.
- You must include a valid physical postal address in marketing email where the law requires one, and identify yourself accurately.
- You are responsible to your email provider for your complaint and bounce rates, and to your recipients for what you send them.
We may suspend an account we reasonably believe is being used to send unsolicited bulk email, phishing, or content that is unlawful in the places it is delivered.
Your data, and ours
You keep all rights in the data you put into Pharos. We claim no ownership of your contacts, campaigns or content, and we process contact data only on your instructions — see the privacy policy.
You are responsible for having the right to upload what you upload, and for the accuracy of what you tell your subscribers.
Accounts, keys and agents
You are responsible for activity under your account and under any API key issued from it. Keys are shown once and stored only as a hash; keep them secret, scope them narrowly, and revoke a key you think has leaked.
Pharos is built to be driven by automated agents, and the credential model reflects that: agent keys are provisioned without the two send scopes, so a model can draft a campaign and resolve exactly who would receive it but cannot deliver it. If you deliberately grant a key send permission, what it sends is your responsibility.
Acceptable use
You agree not to use Pharos to:
- send unsolicited bulk email, phishing or malware;
- impersonate another person or organization, or send from a domain you are not authorized to use;
- store or transmit special-category personal data, payment card numbers, or health records;
- probe, overload or circumvent the service's access controls or rate limits, or attempt to reach another customer's data;
- break the law, in any jurisdiction your mail reaches.
Fees
Billing is not currently active and no plan is charged. When it launches, prices and what happens on non-payment will be set out before any charge is made, and continuing to use a paid plan after that point will be what constitutes agreement to it.
Email delivery is never billed by us — you pay your own sending provider directly, at their rates.
Availability and warranties
Pharos is provided as is, without warranty of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted or error free, and there is no uptime commitment at present.
Email deliverability in particular depends on your sending provider, your domain configuration and your recipients' mail hosts. We cannot and do not guarantee that any message reaches an inbox.
Liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Our total liability arising out of these terms is limited to the greater of the amounts you paid us in the [12] months before the claim, or [USD 100].
Nothing here limits liability that cannot be limited by law, including for fraud or death or personal injury caused by negligence.
Ending it
You may stop using Pharos and delete your data at any time. Export your contacts to CSV, or read them out through the API, before you do — deletion cascades through projects and is not reversible once backups age out.
We may suspend or terminate an account for a material breach of these terms, giving you notice and a chance to fix it where the breach is fixable and the circumstances allow.
General
These terms are governed by the laws of [jurisdiction], and the courts of [jurisdiction] have exclusive jurisdiction. If a provision is held unenforceable the rest stands. Our failure to enforce a provision is not a waiver of it.
